Abstract
No presente trabalho procura-se analisar, sob o aspecto jurídico penal e constitucional, a atividade dos movimentos populares que lutam pela reforma agrária no Brasil, em especial no que tange a invasão de propriedades rurais. Para tanto abordamos analiticamente o crime de esbulho possessório, previsto no § 2º, do art. 161, do Código Penal, bem como a questão da reforma agrária e a função social da propriedade como preceituado na Constituição Federal de 1988.
